Appeals court hears arguments on President Trump's revised travel ban

Not only did this judge create an affirmative right for foreign nationals with visas to enter the country, he took it a step further and enjoined even the second Trump order, which only affected hypothetical prospective immigrants/travelers from six countries who haven't even applied yet!

The Muslim-ban language remained online until Monday afternoon, when they were scrubbed from the website shortly after Spicer was pressed on why the plan was still on the President's campaign website.

The 4th Circuit is considering whether to leave in place the Maryland decision siding with challengers who say the order violates First Amendment prohibitions on government condemnation of a particular religion. A three-judge panel of the 9th U.S. Circuit Court of Appeals will hear arguments in that case next week. Chuang ruled at the time that the portion of the President's executive order that banned travel from six Muslim-majority countries was unconstitutional.

Trump issued the March executive order after federal courts blocked an earlier version, issued on January 27 a week after he took office, that also had included Iraq among the nations targeted.

A federal judge in Hawaii has also blocked the six-country travel ban as well as the freeze on the USA refugee program. "We all know what that means".

Judges Robert King, Henry Floyd and James Wynn referred to Trump's remarks several times during the hearing.

The statement was brought up during the press briefing because despite the statement's call "for a total and complete shutdown of Muslims entering the United States until our country's representatives and figure out what is going on", the Trump administration is now denying that Trump's executive order banning travel from several predominantly Muslim nations is a Muslim ban.

Refugee groups and individuals separated from family members overseas said they are taking the president at his own word: trying to use public statements by Trump and his aides during the campaign and after to prove the order is motivated by religious animus.

What is it about their nationality, she asked, that "renders them suspect or renders them unsafe?" "He's saying I'm not certain".

The challengers in the Maryland case include six people, some of whom are US citizens, who say the ban would prevent family members from entering the United States. They are being represented by the National Immigration Law Center and the American Civil Liberties Union.

"Who makes the national security determination in this case, the risk I am addressing?" asked Judge Dennis Shedd.

Spicer responded he was not aware of what was on the website, adding the White House has been "very consistent" in referring to this policy as a "travel ban". The DOJ's lawyer, acting solicitor general Jeffrey Wall, argued that Trump's statements should not be held against him because they were made before he took the oath.

Chuang went on to explain that the consideration of such evidence by a federal court is a matter of "common sense", as such "explicit statements of a religious goal are "readily discoverable facts" that allow the court to identify the objective of this government action without resort to 'judicial psychoanalysis'".

In a hypothetical, Jadwat speculated about how it would be perceived if a presidential candidate spoke of his dislike of Jews and, upon being elected, blocked travel from Israel because of a history of terrorist incidents there and the presence of a terrorist element in the country. "If this order were legitimate and actually doing what it said it was doing, it would do something different", he said.

"What if he says "sorry" every day for a year", Shedd quipped, drawing laughter from those seated in the courtroom.

Joan Larsen, who now serves on Michigan's Supreme Court, will be nominated by Trump to serve on the 6th Circuit Court of Ap0peals. However, judges accelerated the process Monday by having the case heard by the full court - instead of just three judges it typically assigns to hear initial arguments.

The court has 15 active judges, but two have recused themselves over potential conflicts of interest, including conservative judge J. Harvie Wilkinson, Wall's father-in-law.
