Flynn will not honor Senate subpoena

The lawyer for embattled former national security adviser Michael Flynn said Flynn won't comply with a Senate Intelligence Committee subpoena, according to the committee's top Republican.

Burr added that the committee, which is investigating Russia's interference in the 2016 election, would be evaluating its next steps.

Asked about his opinion of the president now, Flynn reiterated his loyalty to Trump.

Burr's initial announcement prompted many folks on Twitter to say the move meant that Flynn could end up in jail: contempt of Congress!

Burr says he would welcome Flynn's willingness to cooperate. Richard Burr, announced that Flynn would not be complying with the Senate's subpoena - although he later walked that back by saying that he'd not yet gotten a "definitive answer" from Flynn's lawyer.

Flynn's attorney Robert Kelner did not immediately respond to phone messages and emails seeking comment.

Though Flynn has left the Trump administration, the controversy surrounding him has not subsided as newly announced special counsel Robert Mueller, Congress and the FBI investigate potential collusion between Trump campaign associates and the Russian government. At the time, Trump said he fired Flynn because he misled senior administration officials, including the vice president, about his contacts with Russian officials.

The communications had been intercepted by the USA intelligence community because they involved Russian officials, who are routinely monitored for national security concerns. In March, the committee rejected Flynn's request for immunity from prosecution. The House did this anticipating the Justice Department's refusal to prosecute Holder in 2012, only to have a federal judge turn them down as well. On Jan. 26, former deputy Attorney General Sally Yates told McGahn, who had transitioned into role of White House Counsel, that the DOJ possessed evidence that Flynn had not been forthcoming to Vice President Mike Pence about his communications with Russian officials. That inquiry is looking into whether Flynn was fully forthcoming about his foreign contacts and earnings from organizations linked to the governments of Russian Federation and Turkey. Typically, certifications against sitting executive branch officials have been made to the U.S. Attorney for the District of Columbia.
