Pak describes India's approach to ICJ on Jadhav as diversionary tactic

India on Wednesday said its move to approach the International Court of Justice on alleged Indian spy Kulbhushan Jadhav was a carefully considered decision to save the life of an Indian and ensure justice after Pakistan denied its 16 requests for consular access.

International Court of Justice President Ronny Abraham has reportedly written a letter to Pakistan government, asking it to act in such a way which would enable the implementation of any order the ICJ may issue in the case.

The website of the All India Football Federation (AIFF) was hacked on Tuesday night apparently by Pakistani hackers who defaced the site and demanded the hanging of Indian spy Kulbushan Jadhav.

In its application, India has also stated that Jadhav would be executed should the ICJ not interfere, and that would cause "irreparable prejudice to the rights claimed by India".

Swaraj also revealed that Senior Advocate Harish Salve will be representing India before the ICJ in the matter.

Indian authorities say they learned of his March arrest through a press release almost three weeks later and were refused consular access 13 times, in violation of the Vienna Convention.

Jadhav was "shown to have been arrested in Baluchistan" on March 3, 2016, India claimed, according to the ICJ handout. But Pak defense minister Khawaja M. Asif said India approached the ICJ as a diversionary tactic. He said unfortunately there is still no information on Jadhav's location or condition.

The ICJ press statement doesn't say whether the court stayed the execution.

In his media briefing May 10, Baglay said India has been denied consular access to Jadhav despite 16 requests to Pakistan, which was a "contravention of global law".

India further said that, in violation of the Vienna Convention, the authorities of Pakistan were denying it its right of consular access to Jadhav, despite its repeated requests.

Ahmer Bilal Soofi said that he was surprised that India had chosen to invoke the ICJ's jurisdiction while both Pakistan and India are parties to a 2008 bilateral Consular Access Agreement.

"He (Jadhav) acquired premature retirement from the Indian navy and since then the government has nothing to do with him", said Vikas Swarup, a spokesperson for the Ministry of External Affairs, requesting Pakistan to grant counsellor access to the "arrested Indian citizen".

Pakistan claims Jadhav confessed to being tasked by India's intelligence service with planning, coordinating and organising espionage and sabotage activities in Balochistan near the Iranian border with the aim to "destabilise and wage war against Pakistan".

"I am not sure it is a wise move to go to the ICJ". Islamabad had also not responded to India's request for papers - chargesheet, court documents, evidence etc relating to Jadhav's case.
