On Thursday, a three-judge panel in the Seventh Circuit upheld the decision to vacate the conviction.

Dassey's attorneys asked the court to release him immediately.

Brendan Dassey's defense has responded to the state's request to keep Dassey behind bars pending a full review of its appeal, saying the request is "not warranted".

The state Department of Justice's filing argues Brendan Dassey should remain in prison because his case is far from settled.

Dassey and his uncle, Steven Avery, have been serving life sentences, after being convicted for killing the freelance photographer.

The state disagrees with Dassey's attorneys argument that circumstances have substantially changed.

His lawyers also said they believe the state is "highly unlikely" to successfully seek reversal of the court's decision to uphold Dassey's overturned conviction.

Dassey and his uncle Steven Avery are the Wisconsin men at the center of the hit Netflix film Making A Murderer. The discussion about his nephew, Brendan Dassey, however was much less conflicted. "Dassey, seeking the promised result - freedom, or avoidance of conflict - searched for the narrative that the investigators would accept as 'the truth, '" she said. Back in August of 2016, a federal magistrate judge ruled in Dasseys' favor, agreeing that his confession to the murder had been coerced and was therefore inadmissible.
