Cosby Rape Trial Heads To Jury; Defense Called Only One Witness

Cosby was painted as a predator and callous manipulator by the prosecution, while the defence portrayed him as a lover and kindly mentor.

In his closing statement to the jury, District Attorney Kevin Steele said: "Drugging somebody and putting them in a position where you can do what you want with them is not romantic".

The jury, which deliberated for four hours and will reconvene Tuesday morning, will decide whether Cosby is guilty of three counts of aggravated indecent assault, each of which carries a possible 10-year sentence. "With rhetorical dilemmas to resolve". "Who says something like that when you're in that situation?"

Cosby, best known for his role as the dad in the 1980s hit family TV comedy "The Cosby Show", was charged in late 2015 with sexually assaulting Andrea Constand, just days before the statute of limitations on the alleged crime was to run out.

Johnson, who worked at the William Morris talent agency, said that in 1996, Cosby gave her a pill that incapacitated her and then he sexually assaulted her.

McMonagle cast blame on the media for giving Cosby's accusers - who now number 60 - a forum. He says she doesn't say 'yes.' He says he put his finger.

The defense offered its closing argument after presenting a single witness: a detective who reminded jurors that Constand had visited with Cosby after the encounter. He also described three pillars of the case had been proven: 1) Cosby drugged Constand; 2) She was "legally" unconscious; and 3) She was unable to consent to sexual activity. Among those listening was Camille Cosby, 73, his wife of 50 years and business manager. She slipped into the courtroom while the judge was addressing the audience and the attorneys.

She sat in the first row behind Cosby.

Philadelphia defence lawyer Alan Tauber says that's less likely in Cosby's case because his fame makes him an unlikely flight risk.

Lawyers for Cosby called just one witness, the Montgomery County detective Richard Schaffer, whom the prosecution had called last week as its witness, to ask some follow-up questions.

Judge Steven O'Neill asked Cosby a series of questions created to make sure he was aware of his right to testify and wasn't pressured into deciding against it. Cosby spoke loudly as he answered, responding "YES!" or "NO!" In criminal trials, the onus is on prosecutors to prove guilt beyond a reasonable doubt, and defendants are not required to take the stand.

The judge at one point addressed Cosby to ask him a few standard questions.

The lawyer wound down by saying that while Cosby was "not perfect" what was happening was an injustice.

Prosecutors will give their closing argument Monday afternoon.

"This ain't right!" bellowed McMonagle.

A deposition in that case provided no new information about the night that Constand says Cosby assaulted her, McMonagle said. The implication is that she was after money from Cosby, one of America's wealthier stars. "She spent a lot more time trying to forget what happened than trying to remember that night". Instead, he was intent on persuading the jury that Constand was a "lover" of the comedian - not a victim.

"Ms Constand was untruthful time and time and time again", Mr McMonagle told the jury. Yet to Cosby's defense team, the prosecution represents something else - a he-said, she-said where she says she was violated, and he says the encounter was mutually gratifying and romantic.

The jury also heard quotes during the trial from Cosby's deposition about his use of Quaaludes in the 1970s.

He noted Cosby's familiarity with the effects of Quaaludes - which he had previously said he had administered to women he wanted to have sex with, according to his 2005 civil deposition - as well as Benadryl, which he claimed he gave to Constand.

"All the fancy lawyering you have can't get you around your own words, your own statements", Steele said.

"What are we doing here?" he said repeatedly.

The fast-moving case went to the jury on Day 6 of the trial after closing arguments gave differing portrayals of what happened between Cosby and Constand.
