Dominique Heaggan-Brown, who is also black, was found not guilty of first-degree reckless homicide in the killing of Sylville Smith, who was carrying a semi-automatic pistol during a brief foot chase that led to the shooting.

The intense moments during August 13, 2016, were captured on police radio just before Smith was shot and killed. "As he fired, defendant Heaggan-Brown was standing directly over Smith-an execution-style shooting of an unarmed civilian". He shot him again 1.69 seconds later, this time in the chest, when Smith fell on his back with his legs in the air.

Mayor Tom Barrett said there would be a strong police presence at Sherman Park on Wednesday, though as of the early evening, there were no reports of disruptions or violent protests around the city.

Because he remains in custody on a pending, unrelated sexual assault charge, Heaggan-Brown, 25, did not get walked out of the courtroom.

FILE - This undated file photo provided by the Milwaukee County Sheriff's Office shows Sylville Smith. "Where's the test they're supposed to take on these officers?"

The fatal encounter transpired over 12 seconds from the time Heaggan-Brown got out of his vehicle to begin chasing Smith to when the fatal shot was sacked. Smith was on the ground when he received the fatal shot.

The jury is made up of nine women and three men.

Because the charges related to that incident are to be handled separately from the killing of Smith, information related to the alleged rape was not presented to the jurors to factor into Wednesday's decision.

The family says that Smith posed no threat and that Heaggan-Brown was never in any danger that would justify the use of deadly force.

It took a mere 12 seconds from the beginning of the foot chase to the fatal shot. "Black or white, because we all bleed the same, we all hurt the same, and it don't feel good to lose anybody", said Sherelle Smith.

"Everybody understands, not just in this community but throughout the country, that the relationship between law enforcement and the justice system and the communities they serve is under some severe strain right now", Chisholm said.

Despite visible public anger and attention from the news media toward police shootings in recent years, criminal prosecutions of the officers involved remain rare, and convictions even more so. The officer moved his hand away from Smith's waist, according to court documents.

Heaggan-Brown's first shot hit Smith in his arm.

Heaggan-Brown stared at the judge as the verdict was read with little reaction.

Heaggan-Brown was the third United States law enforcement officer to be tried for a shooting in the last week.

Malafa's body camera footage was played several times in court, according to WTMJ.
