Maryland and DC Sue Trump, Alleging He Violated Constitution's Anti-Corruption Clauses

"From day one, President Trump has been committed to complete transparency and compliance with the law", RNC spokeswoman Lindsay Jancek said in a statement.

But the two Democratic attorneys general say their lawsuit is unique, because they are suing as sovereign entities on behalf of residents of Maryland and Washington, D.C. They say the Trump Hotel in the nation's capital affects business in the Washington area.

"The emolument clauses are a firewall against presidential corruption", said Maryland Attorney General Brian Frosh."He's going to have to answer in court".

According to Karl A. Racine, the D.C. Attorney General and Brain Frosh, the Maryland Attorney General, Trump's violations have gone too far.

However, that fight would most likely end up before the Supreme Court, with Trump's attorneys having to defend why the returns should remain private, local media quoted the two as saying.

The White House said Monday the president's business interests do not violate the Emoluments Clause, and that the lawsuit is nothing more than blatantly partisan politics. An attorney for Trump said in January that the president was resigning from the Trump Organization and handing leadership over to his sons to avoid the appearance of a conflict of interest.

The lawsuit is the latest and most significant legal challenge to Trump over the issue of emoluments and thought to become another legal headache for Trump following special counsel Robert Mueller's probe into possible Russian meddling in the USA presidential campaign and court challenges to the president's controversial travel ban.

"The President is paid by companies owned by foreign governments including China, he said".

Payments to the president's enterprises from foreign and domestic governments through his hospitality empire draw business away from Maryland and D.C. venues and put local governments under pressure to give Trump-owned businesses special treatment, according to the complaint.

This new suit was brought by attorneys general who are both Democrats, Spicer noted.

The domestic Emoluments Clause says presidents will receive payment for their time in the White House and may not receive payment or "any other emolument" from a USA state or a foreign government during this period.

This is the second lawsuit against Trump over his alleged violations of the anti-corruption clauses of the Constitution.

The President has continually brushed off calls from Democrats to release his tax returns. They also have planned new businesses in the United States.

Lobbyists, foreign diplomats and others who might wish to curry favor with Trump have been frequenting the Trump hotel, which is unfair, the argument goes.

The emoluments clause bars the president and other government employees from accepting foreign gifts and payments without congressional approval.
