SC adjourns Vijay Mallya contempt case says his presence a must for any action

Following a brief hearing, the bench in its order said: "The contemnor (Mallya) failed to appear despite he being represented by counsel".

The Supreme Court on Friday demanded the presence of liquor baron Vijay Mallya in connection with a contempt case filed against him, insisting that no proceedings can go ahead without him. "Extradition proceedings are on and all steps are being taken by the government to produce him before the court".

The court was informed that the final hearing in the British court for the extradition of Mallya would start from December 4 and conclude by the month-end.

The bench comprising Justice A K Goel and U U Lalit, while taking note of the submission, asked the government to produce him before the court.

In the last hearing, the apex court had convicted Mallya for contempt of court and summoned him to personally appear on July 10.

Mallya, who has been in the United Kingdom since March 2016, was arrested by Scotland Yard on April 18 this year, and India has been trying to extradite him from the United Kingdom for the loan fraud cases.

India had recently asked Britain to ensure early extradition of Vijay Mallya, an accused in a bank loan default case of over Rs 9,000 crore involving his defunct Kingfisher Airlines.

The case was being upheld on a plea made by a consortium of lender banks led by the State Bank of India (SBI) after it had contested that Mallya had allegedly transferred at least Dollars 40 million received from Diageo to his children in violation of judicial orders. "Matter be put up before us on his (Mallya) production before this court", the bench noted in its order.
