Supreme Court lifts ban on sale of firecrackers in Delhi-NCR directs cops to remain vigilant

The Supreme Court on modified its November 2016 order suspending all licences for sale and retail of fire crackers within Delhi NCR. Justice Madan B Lokur said, "There is enough quantity of crackers already available in the regions of Delhi, NCR". Also, licenses will be reviewed after Diwali depending pon the quality of air between the post-Diwali and after Diwali. The top court said that unless urgent steps are taken, there could be an adverse impact on children's health and it would be to "nobody's benefit but to everybody's detriment".

It observed that large number of temporary licences were issued for possession and sale of fireworks in Delhi-NCR and there was a need to regulate the availability and sale of fire crackers here.

Also, the Court appealed the Delhi Government and the other authorities for the encouraging of fireworks display through community participation rather than the individual bursting.

The bench said in its order,"Similarly, the States in the NCR are restrained from granting more than 50 per cent of the number of temporary licenses granted in 2016".

It said the health of people in Delhi-NCR must take precedence over any commercial or other interest of the fire crackers manufacturers and a graded regulation was needed which would eventually result in prohibition.

The court has directed constitution of a committee chaired by Chairperson of Central Pollution Control Board (CPCB). However, this year Diwali came on 19th October 2017.

It also directed the police authorities and the District Magistrates to ensure that crackers are not burst in silence zones and has asked the Department of Education to formulate an action plan in 15 days with a view to sensitizing school children on the health hazards of pollution.

Regarding the health issues of children and Pollution Court has taken this decision. The bench also noted that there was no response from the states within the NCR, which gave the impression that air pollution was not a problem for them despite the ill-effects and health hazards of bursting fireworks.

While making absolute its July 31 direction that prohibited use of metals like antimony, lithium, mercury, arsenic, and lead in the manufacture of fireworks, the court permitted the sale of fireworks containing aluminium, sulphur, potassium, and barium.
