Court Gives INEC Permission to Begin Recall of Melaye

While ruling on the required signature to proceed with the recall, justice Dimgba held that in the face of the statistical analysis accompanying the suit, the number of signatures gathered to begin the recall process in Melaye Senatorial's district was 188, 588 out of the 360,100 ‎registered voters.

Federal High Court sitting in Abuja has dismissed Senator Dino Melaye's suit which is challenging the validity of the recall process embarked upon by his Kogi State Western Senatorial district.

On the complain of lack of fair hearing by the constituents before forwarding the recall petition to INEC, the judge said it lacks merit and dismissed it.

Justice John Tsoho of the Federal High Court had ordered INEC to maintain status quo on Melaye's recall, pending when the latter's suit against the commission is heard.

The recall of the senator which was earlier scheduled for July, 2017, was earlier put on hold by the court.

Countering the petition filed by the APC senator, the presiding judge stated that his Kogi-West constituents were not mandated to afford him fair hearing before sending their petition to INEC.

Describing Melaye's suit as being "hasty, premature and presumptuous", Dimgba noted that INEC had already indicated that it would schedule a period to verify the signatures of the petitioners who called for the senator's recall from the upper legislative chamber.

He ordered INEC to issue an amended recall timetable in which it should give Senator Melaye a minimum of two weeks to allow him prepare his defense against the recall process.

After all the fanfare about the call to recall Dino Melaye in June, many must have wondered if as expected the case had just quietly died.
