The Justice Department said in a court filing Monday that it agrees a federal judge should erase her finding that former Arizona Sheriff Joe Arpaio violated a court order and was guilty of criminal contempt - a move that would have virtually no practical impact but which Arpaio considers a symbol of vindication.

"I do not doubt that Trump thinks that everything Joe Arpaio did was or should be part of a law enforcement officer's job, and that is the real problem here", says Oliver in his first episode since the show's recent hiatus.

In court docs, the department argues that Trump's pardon made Arpaio's conviction "moot" and the court should "vacate all orders" against the disgraced former sheriff.

A pair of legal advocacy groups have filed amicus briefs in the case, claiming the president's pardon of Arpaio was unconstitutional and undermines the power of the federal court system.

Trump pardoned Arpaio, the former sheriff of Maricopa County, Arizona, on August 25.

The DOJ argues since Arpaio won't face any consequences for his conviction due to the president's pardon, the court should "vacate" the verdict.

US District Judge Susan Bolton in Phoenix is scheduled to hear arguments on what should happen to Arpaio's case on October 4.

Bolton was expected to make her decision during an October 4 hearing.

Since the pardon, Arpaio has said he did nothing wrong, criticized Bolton as biased and called the offense behind his conviction a "petty crime". The Arpaio Pardon does not faithfully execute the law; it sends a signal that public officials, so long as they are allies of the President, need not execute the law at all. Bolton found Arpaio guilty in July of disobeying another judge's order that his office stop detaining people based exclusively on the suspicion that they were unlawfully in the United States.

"The President may no more use the pardon power to trample the rest of the Constitution and the Bill of Rights, than he may use the Commander-in-Chief power to call down airstrikes on political opponents", the brief reads.
