Federal court reinstates Ezekiel Elliott's 6 game suspension

The Fifth Circuit Court of Appeals has ruled that Elliott's injunction of his six-game suspension for violating the league's personal conduct policy is to be vacated, which means he'll have to file another appeal to continue playing.

In the wake of today's ruling, the NFLPA is expected to re-file the case with the U.S. District Court for the Southern District of NY and could seek a temporary restraining order and preliminary injunction which would allow Elliott to keep playing, according to Gabe Feldman, director of the Tulane Sports Law Program (H/T NFL). Stay with KLTV for updates. Elliott could still avoid the suspension for now if the NFLPA files for a temporary restraining order in the Southern District of NY and the court grants their request.

Thursday's ruling came down ahead of the Cowboys' bye week, giving him ample time to restart the legal fight. The Cowboys have a bye this weekend before resuming play October 22 at San Francisco.

With Elliott likely out, running back Alfred Morris will be inserted into the starting lineup with Darren McFadden spelling him.

A three-judge panel heard arguments on the case on October 2.

Important to note, Elliott was never prosecuted for the incidents - and he maintains his innocence. The NFL filed in NY and they thought this would help them win this case having it away from Elliott's home state of Texas. This is the same court that ultimately ruled in the NFL's favor against Patriots quarterback Tom Brady in the deflate gate scandal.
