Sankey said the panel was "troubled" by the University's shifting opinions on whether the classes constituted academic fraud - but that NCAA policy defers this determination to member schools.

"A singular principle allowed UNC room to make its claims and, ultimately, limits the panel's ability to conclude that academic fraud occurred", the Public Infractions Decision said.

Women and men athletes were alleged to have benefited from the courses.

"In short, the courses involved no class attendance; limited, if any, faculty oversight; and liberal grading", the NCAA said in its report, which also said at least 3,100 students enrolled in such courses over about two decades "involving irregular instruction". However, the investigation was focused from 2002-11.

One of the largest referrers to these fake courses run by the African and Afro-American Studies department was UNC's fraternity system. The athletes were reportedly guided into the classes to help remain academically eligible.

In its response to the case, North Carolina challenged the most serious and potentially damaging allegation, arguing that "inadequate academic oversight unrelated to the Department of Athletics" didn't constitute an issue within the NCAA's jurisdiction. The panel noted the former secretary credibly explained during the hearing that she treated all students the same. "Additionally, the record did not establish that the university created and offered the courses as part of a systemic effort to benefit only student-athletes".

Rest easy, Tar Heels. North Carolina also won a national championship this past season, but that title was never in question.

"Based on the general availability and the lack of specific examples, the panel can not conclude a systemic effort to impermissibly benefit student-athletes", it said. North Carolina was facing five major charges, including lack of institutional control.

The only penalties levied were a three-year "show cause" placed on former UNC department chair Jan Boxill and a reprimand for AFAM secretary Debra Crowder - neither of whom are affiliated with the university anymore.
