4-year-old booked for 'raping' classmate in Delhi school

Summary: A four-year-old boy has been accused of sexually assaulting his classmate with a pencil at a school in Delhi's Dwarka.

According to media reports, the four-year-old girl said the boy from her class unbuttoned her trousers and used his fingers to assault her in the classroom and washroom of the school.

In the complaint, the mother also said, "I spoke to the principal as she had not bothered to answer my call or respond to my mail".

The mother of the girl has also alleged inaction by school authorities, she had complained to a schoolteacher via a "text messages" regarding the incident and the school reportedly did not assist the family.

According to the parents, she narrated the whole incident that took place during the school hours, wherein one boy of her class opened her trousers and put his finger inside her private parts.

After the doctors at Rockland Hospital examined the victim and confirmed it to be a case of sexual assault, the parents lodged a complaint at the Dwarka Police Station.

The victim later narrated to her parents how her classmate opened her trousers, and put his finger inside her private parts, the FIR read.

Dependra Pathak, Delhi Police's chief spokesperson told Hindustan Times: "The Indian Penal Code (IPC) provides children below seven years of age certain protections against prosecutions". It was then that the victim's mother approached the police. "We are examining those provisions even as we are handling the matter with utmost sensitivity".

The mother has alleged that when the assault took place, the teacher and the helper in the washroom were absent. While, NDTV reported that the school has said that it was "impossible" that 4-year-old girl was sexually assaulted by another classmate of the same age, their lawyer had earlier denied charges of negligence. She added that they also refused to provide her details of the accused.

The child's mother alleges that there was no class teacher or an ayah present in the classroom or the washroom at the time of the assault.

Behaviour science experts believe that it would be unwise to criminalise the child as pre-puberscent children, especially that young, do not understand sexual behaviour. Is there a possibility of a sexual need being fulfilled in his case?
