A ministerial committee has been constituted to draft the legislation, sources quoted as saying.

On August 22, three of five judges on a Constitution Bench - Justices Rohinton F Nariman, Uday U Lalit and Kurian Joseph - called the practice un-Islamic and "arbitrary" and disagreed with the view that triple talaq was an integral part of religious practice.

Centre is likely to introduce a bill in upcoming Winter Session that will put an end to Triple Talaq practice, which was struck down by Supreme Court earlier this year, calling it "unconstitutional".

"The need of the hour is to enact a strict law against triple talaq in one go that is similar to the anti-sati law to prevent any Muslim woman from getting victimised and ensure that the culprit is punished", he said.

There are several complaints of instant triple talaq where Muslim women say they have been left destitute by husbands divorcing them through triple talaq, including by Skype and SMS. This could be because of the lack of knowledge of Muslim husbands of decision of Supreme Court.

"There have been reports of number of divorces by way of talaq-ul-biddat happening even after the SC judgement". "The government's endeavour to bring a suitable legislation/amending existing penal provisions will be a step forward to this end".

It may be recalled that during the arguments in the Supreme Court in the triple talaq case, members of the Muslim community who were opposed to judicial intervention in a matter of "personal law" - especially lawyers representing the All India Muslim Personal Law Board - had submitted that they were open to the government making the practice of instant triple talaq illegal by way of a legislation.

The Centre felt that this was because of two reasons. While annulling the instant triple talaq the Supreme Court had set the timeframe of six months for the Centre to frame a law to end it. Even police are helpless as no action can be taken against the husband in the absence of punitive provisions in the law.

The government feels that as the law stands today, the victims of Talaq-e-biddat have no option but to approach the police for the redressal of their grievances as the Muslim clergy would be of little assistance to them.
