A federal grand jury issued an indictment on Tuesday against Jose Inez Garcia Zarate, the undocumented immigrant who was acquitted on state charges of murder and manslaughter last week in the shooting of Kate Steinle. The San Francisco sheriff's department also released him from jail several weeks before the shooting despite a request from federal immigration officials to detain him for deporation.

Garcia Zarate, who is from Mexico and has been deported from the U.S. five times, faces up to 10 years in prison on each count, if convicted.

Prosecutors said Garcia Zarate deliberately fired into an unsuspecting crowd on the pier in July 2015, killing Steinle as she walked with her father. Garcia Zarate has been in jail since July 1, 2015. Garcia Zarate claimed the shooting was accidental.

San Francisco District Attorney George Gascon on Tuesday defended his office's handling of the case.

Garcia Zarate admitted to shooting Steinle, but said he had picked up a gun from under a bench on the pier and it went off accidentally.

The shooting sparked a national debate over immigration Because Garcia Zarate was deported to his native Mexico five times before he was arrested a few hours after the shooting.

Jurors could also have convicted Garcia Zarate of second-degree murder or involuntary manslaughter but chose not to.

President Trump slammed the jury decision in the case last week, writing in a tweet, "No wonder the people of our Country are so angry with illegal Immigration".

The case also caught the attention of presidential candidate Donald Trump past year, who used it to highlight crime committed by undocumented immigrants during his campaign.
