Summer Zervos filed the suit in January, accusing Trump of unwanted sexual touching and likening his behavior to a "sexual predator who had preyed on her and other women", according to a statement from her attorney, Gloria Allred.

Kasowitz Benson attorneys Christine Montenegro and Paul Burgo are also on the president's legal team.

Trump has said accusations by Zervos and other women who previous year accused him of sexual harassment are false. They could, for example, meet Trump during one of his weekend visits to his Mar-A-Lago resort in Florida to record a video deposition, she suggested.

Trump's denials were political speech, he said, protected from legal action, and a lawsuit would prevent the president, who holds a singular office, from performing his job.

At an October 9, 2016, presidential debate, Zervos' complaint states, Trump said that he had never done the things he bragged to Bush about and that his comments were nothing more than "locker room" talk.

Wang retorted that her client simply "detailed report of her interaction with at the time Donald Trump and it sticks to the facts and it describes him thrusting his genitals at her and grabbing her breasts".

The motion to dismiss "has nothing to do with putting anyone above the law", Kasowitz said.

Mariann Wang, the lead lawyer for Zervos, argued, "There is no case that holds that a federal official can not be held to account in a state court". The ruling came after Paula Jones filed a sexual harassment lawsuit against President Bill Clinton, husband of Trump's main opponent in the 2016 presidential election, Democrat Hillary Clinton.

Even though the justices allowed for Clinton to be haled into court, Kasowitz said that under the principles in that decision, a federal court would be a more appropriate venue when a president is a civil defendant.

Trump's lawyers have said that Clinton v. Jones only applies to lawsuits in federal courts, not state courts. But since then, accusations of sexual misconduct against media mogul Harvey Weinstein by dozens of women started a tsunami of misconduct claims against powerful men in media, politics, business and the arts.
