In a pair of filings in the Supreme Court, Solicitor General Noel J. Francisco said Mr. Trump had acted under his broad constitutional and statutory authority to control immigration when he issued a new proclamation in September announcing the new travel restrictions.

SEATTLE-The U.S. Supreme Court's decision allowing U.S. President Donald Trump's third travel ban to take effect - at least for now - has intensified the attention on a legal showdown Wednesday afternoon before three judges in Seattle who have previously been cool to the administration's efforts.

The Trump administration said the president put the latest restrictions in place after a worldwide review of the ability of each country in the world to issue reliable passports and share data with the United States.

"Based on that review, the proclamation adopts tailored entry restrictions to address extensive findings that a handful of particular foreign governments have deficient information-sharing and identity-management practices, or other risk factors".

Hawaii's attorney, Neal Katyal, said in court papers "it is hard to conceive of a more flagrant example of discrimination because of nationality". The move did suggest that the administration's chances of prevailing at the Supreme Court when the justices consider the lawfulness of the latest ban have markedly increased.

The justices said the cases were moot since the orders had expired and there was no longer a "live case or controversy" to settle.
