Ex Volkswagen executive jailed in US amid diesel scandal

Former Volkswagen executive Oliver Schmidt, who has pled guilty to criminal charges that he conspired to cover up the automaker's diesel emissions cheating scandal, was sentenced Wednesday to seven years in prison by a MI federal judge. Schmidt was also ordered to pay a criminal penalty of $400,000, according to a US Department of Justice (DOJ) press release.

Lawyers spent roughly 90 minutes giving different views about Schmidt's culpability in the scandal in Detroit federal court on Wednesday. He pleaded guilty in August to charges that included defrauding the United States and violating the Clean Air Act.

Schmidt's lawyer. David DuMouchel of Detroit, asked for a maximum of 40 months in prison and $100,000 fine.

Oliver Schmidt, the second and most senior employee of the German automaker to plead guilty in the emissions cheating scandal, is among seven current and former VW executives that United States prosecutors have charged so far.

"I made bad decisions and for that I am sorry", he said. Only one other VW employee has been sentenced in connection with the emissions scandal: former engineer James Liang, who received 40 months in prison and two years of supervised release as the result of his plea deal.

VW used sophisticated software to cheat emissions rules on almost 600,000 USA vehicles.

Former Audi executive Giovanni Pamio also remains at large.

The software reduced harmful emissions of nitrogen oxide when the cars were being tested, but on the road, the emissions were well over limits to control pollution.

Schmidt led VW's engineering and environmental office in MI from 2012 to early 2015. As VW Group rolled out its massive "clean diesel" marketing campaign appealing to environmentally conscious auto buyers, those same cars were actually emitting nitrogen oxide (NOx) many times in excess of the legal limit.

Prosecutors say Schmidt concealed the software tricks to California regulators while offering "bogus" explanations of any differences in emissions.

"The defendant has a leadership role within VW", federal officials said.
