However, Australian pair Sean Carey and Beau Golden filed a complaint in NY federal court on Wednesday (10Jan18), saying that the song is "blatant copying" of their own 2014 tune When I Found You.

Tim McGraw, Faith Hill, Ed Sheeran and others are involved in a lawsuit filed Wednesday (Jan. 10) in a NY federal court over the song "The Rest of Our Life".

Australian singer Jasmine Rae released When I Found You under her name in 2015, and it was the most played song on Australian country radio, according to the complaint, filed in the US District Court in NY.

"The copying is, in many instances, verbatim, note-for-note copying of important and original elements of the song, and is obvious to the ordinary observer", claimed the pair, adding that the allegedly infringing song was "almost a note for note copy" of theirs.

Sony Music Entertainment and the song's other co-writers were also named as defendants. "When I Found You" was released on ABC Records by co-writer and recording artist Jasmine Rae and was a hit in Australia. Busch previously took on Sheeran in a $20 million copyright lawsuit over the superstar's song Photograph - ending in a settlement which earned the two suing songwriters music credits and a significant royalty share.

Carey and Golden claim in their lawsuit that the two songs are musically similar, while also containing similar lyrics and identical themes of love and marriage.

"During this conversation, Mr. Holland admitted to knowing about the Infringing Song months in advance of its release because he was tasked with promoting and marketing the Infringing Song and Infringing Sound Recording before its release", the complaint reads.

Rae was informed of the songs' similarities after a tweet from a fan caught her attention.

The complaint says that based on downloads, Spotify and YouTube streams, TV broadcasts and live performances, Sheeran and his co-writers have profited in excess of $US5 million from The Rest of Our Life.

But it's not just McGraw and Hill who are in trouble with Carey and Golden.

The tricky part is that Jasmine Rae apparently didn't really want to sue Tim and Faith, or Sony, because of the strain that would put on her partner Holland's career.

She brought the issue up to Carey and Golden, who wrote "When I Found You", as well as her boyfriend, Tim Holland, who works as a marketing manager for Sony. "Taking such action would compromise both his position and that of the people he reports to, and this is not something I'm prepared to do".

Sony/ATV, which represents Sheeran, declined to comment on the lawsuit Wednesday evening.
