Did the FBI Mislead a FISA Judge? Why Not Just Ask Him?

Before it was released the FBI, Justice Department, Democratic members of congress and much of the main stream media argued that the memo should not be made public, because it endangered national security.

Bureau officials, a lot of them Republicans, are stunned to discover that the Bureau's tactics have been turned against it in the service of protecting President Trump from criticism and investigation.

Now that the White House is poised to approve the release of Democrats' memo rebutting the controversial Republican-drafted memo from the House Intelligence Committee alleging abuses of the surveillance process by top Justice Department and Federal Bureau of Investigation officials, Republicans in Congress are working to undermine the Democratic memo.

Trump on February 2 allowed the release of the earlier memo written by the committee's Republicans, escalating a campaign criticizing current and former senior law enforcement officials. They're going to say that Donald Trump didn't read it himself so he wasn't aware. Democrats on the House Intelligence Committee have said that Republicans are distorting the roots of the inquiry in an effort to bolster Mr. Trump. If he objects to the release or redacts portions of it, the House Intelligence Committee could vote to override his objections.

The FISA court was established in 1978 by the Foreign Intelligence Surveillance Act to approve electronic surveillance, physical search, and certain other forms of investigative actions for foreign intelligence purposes. Such circular "proof" smacks of "parallel construction" - law enforcement agencies disguising where their information is coming from in order to get what they want from a court without raising questions about constitutionality.

The Trump dossier is of critical importance because it alleged to have been paid for by the Hillary Clinton campaign and the Democratic national Committee. In testimony before Congress, Page said that the meeting was just a cursory one, but later told campaign officials that he met with a Russian official who supported Trump.

Trump tweeted Saturday morning the Democratic memo was a "very political and long response".

Such warrants can be sought by the government, which must persuade special FISA Court judges surveillance is needed to safeguard US national security. White House Chief of Staff John Kelly has given the president's legal team until close of business Thursday to complete its assessment of the Democrats' memo, which Kelly will then use to brief and advise the president. But Democrats and Republicans, including House Speaker Paul Ryan, R-Wis., and Rep. Trey Gowdy, R-S.C., who helped draft the GOP memo, have said it shouldn't be used to undermine the special counsel. The memo says that the application for the warrant referenced a September 23, 2016 Yahoo News article as evidence, despite the article using information that Steele himself leaked.

Not only do they insist on releasing it but they insist on doing so without any corroborated evidence to show that this memo is accurate and indeed the truth.
