The Latest: Survivors' dad reacts to prosecutor's decision

A Florida prosecutor said Tuesday that he would seek the death penalty against the man accused of killing 17 people last month at a high school in Parkland, moving the state closer to a rare trial for someone charged in a mass shooting. His defense attorneys had tried to prevent a death-penalty trial by bargaining with prosecutors for a life sentence in exchange for Cruz's guilty plea.

The notice cited multiple reasons under Florida law for the death penalty including the charges that Cruz "knowingly created a great risk of death" to many people, the shooting was "especially heinous, atrocious or cruel", and it was committed in a "cold, calculated and premeditated manner".

The Marjory Stoneman Douglas High School student is credited with saving the lives of 20 students by attempting to close and lock a classroom door during the February 14 attack where 17 people were killed in Parkland.

Prosecutors' decision to seek the death penalty does not necessarily mean that a plea deal is off the table, though the only other penalty available for Cruz is life in prison without the possibility of parole, The Associated Press reported.

Finkelstein's office did not immediately respond to a request for comment on Tuesday.

His previous not guilty plea indicated that Cruz denied his alleged role in the shooting, even though the evidence against him is overwhelming and Cruz himself has confessed to authorities, they say.

"If we are not allowed to do so tomorrow, we will stand mute to the charges".

Cruz now "stands mute" before the charges, having withdrawn a written "not guilty" plea after being indicted by the grand jury.

Florida voters may get a chance to decide whether or not they want to approve new gun control restrictions.
