Foster has been charged with felony domestic violence after being accused of attacking his girlfriend, authorities said.

Foster did not enter a plea in his brief arraignment on his three felony charges - domestic violence with an allegation that he inflicted great bodily injury, forcefully attempting to prevent a victim from reporting a crime, and possession of an assault weapon - as well as misdemeanor possession of a large capacity weapon magazine.

If Foster is convicted on all of these accounts, he could face more than 11 years in prison.

With Foster unavailable, the 49ers' top two linebackers this spring will be Malcolm Smith and recent free-agent addition Korey Toomer. Foster just finished a solid rookie season and was expected to be a key part of the 49ers defense going forward.

Foster was arrested the morning of February 11 at a home on Shannon Road in Los Gatos after the woman, who has been in a relationship with Foster for several years, flagged down a stranger's auto to get help calling 911.

Foster's arrest following the incident was his second in the span of 30 days.

The team on Sunday issued a statement it said was from CEO Jed York, general manager John Lynch and coach Kyle Shanahan.

That made Foster eligible to work out with the 49ers this offseason.

After being informed that a judge in San Diego issued an injunction prohibiting enforcement of this misdemeanor, the DA intends to ask the Santa Clara County Superior Court to dismiss the charge against Foster. The 49ers have also said that his status with the team largely depends on information gathered during the legal process. After an infamous domestic-violence incident involving former Baltimore Ravens running back Ray Rice, the National Football League granted Commissioner Roger Goodell authority to give players a baseline six-game suspension for domestic violence allegations, even without a conviction, with the discretion to decrease or lengthen the time based on the circumstances of a case.

The 49ers begin their formal offseason conditioning program on Monday at the club's practice facility in Santa Clara.
