The separation tactic is a deterrent - designed simply to make immigrants think twice before heading to the border with their families. Trump's own administration devised a policy to that effect.

Under the terms of the 1997 Flores settlement agreement, reached in connection with a suit against the federal government, migrant children can not be held in jail. Until recently, the result was that families who crossed the border seeking asylum often were released in the US while their cases were pursued. The Homeland Security Department's longstanding policy is to separate children from their custodians when they are referred for criminal prosecution. The comments were calling to his attention the scary plight of the children whom immigration officials have separated from their families at the border.

Immigrant advocates said the new policy would discourage parents from claiming their children. If you don't want your child separated, then don't bring them across the border illegally. This practice is not mandated by statute - it is done out of concern for the welfare of the child.

"These very bad pictures are from 2014, when the government's challenge was reconnecting unaccompanied minors who showed up at the border with family or a safe sponsor", he wrote. He said that most of the sponsors are themselves illegal immigrants, and could easily be deported without a protracted fight over what level of responsibility they bear for the conduct of their charges. "The point is, the administration has said, we would like to terminate or modify the Flores settlement agreement, and also to fund detention space sufficient to maintain the entire the entire family unit together in continuous custody until their removal", unless they qualify for certain immigration relief like asylum, he said. Last year, HHS took custody of more than 40,000 migrant children, and the agency's Office of Refugee Resettlement said it released 93 percent to adult sponsors. "But there's no reason to believe that anything has happened to the kids".
