But the photos are actually from 2014 - when Obama was president. The children are then expected to show up to immigration court to fight their deportation cases.

The 2008 law, created to stem child trafficking from Central America, received wide bipartisan support and was signed into law by then-President George W. Bush, a Republican. In some cases, sponsors simply didn't respond to the follow-up phone call, not surprising because many are themselves in the USA illegally and reluctant to speak to authorities. The separation tactic is a deterrent - designed simply to make immigrants think twice before heading to the border with their families.

But there is no law requiring parents and children to be separated.

Trump also is far from the only president to speak out of both sides of his mouth on immigration - although he might be the first to so blatantly lie about what his administration has chosen to do. Rob Portman, R-Ohio, at the April hearing with Wagner noted a past report about HHS (during the Obama administration) failing to place children with people who would care for them, citing a case of Guatemalan minors who ended up with human traffickers.

Senior administration officials said Tuesday in a call with reporters that they believed adults including gang members and smugglers were using "loopholes" in the existing immigration system to exploit children, and that Congress should change the system if lawmakers didn't like it. 'But I warned at the time that a different administration could do that'.

Marc Short, White House Director Of Legislative Affairs, joins Judy Woodruff to discuss President Trump's agenda, including a potential deal with the huge Chinese tech firm ZTE, the financial effects of the GOP tax cut, reports that migrant children are being separated from their parents and abused, and GOP divisions in the House of Representatives.

For the last decade, the little-known Alien Transfer Exit Program has transported adult male immigrants thousands of miles from the place they were caught at the USA border before releasing them back into Mexico.

Those two statements encapsulate the confusion enveloping immigration policy under President Trump. (DHS told PolitiFact that a family may be separated at a port of entry if the department is unable to determine custodial relationship or if DHS determines that a child may be at risk with the custodian.) Families who are apprehended illegally crossing the border are separated.

Democrats said the administration was trying to deflect responsibility for its own policies.

The American Civil Liberties Union filed a lawsuit in February to challenge the practice.

"The parents are subject to prosecution while children may not be", Sessions said earlier this month.

A mother needs to have the ability to decide whether sending an 18-month-old to a less restrictive facility is the best choice.

"This is long-standing laws that are just being enforced right now".

'The Democrats don't have a solution that would fix all these problems, ' Krikorian added.

What's more, Democrats aren't wholly responsible for either policy.

As the immigration debate lit up social media over the weekend, Trump on Saturday (Sunday NZT) falsely claimed that "we have to break up families" at the border because "the Democrats gave us that law".

'Nobody wanted to get to the state of the affairs that we are at, ' he said. This all happened because of a lawsuit'.

Cable news hosts, out of the blue, have discovered the federal government does a lousy job of keeping track of illegal immigrant children who arrive alone at the U.S. -Mexico border and are taken into custody by law enforcement officials. The administration has said that about 14% of sponsors didn't respond to inquiries.
