Earlier, a 2014 immigration review board ruled that "depending on the facts and evidence in an individual case, "married women in Guatemala who are unable to leave their relationship" can constitute a cognizable particular social group that forms the basis of a claim for asylum".

"The mere fact that a country may have problems effectively policing certain crimes - such as domestic violence or gang violence - or that certain populations are more likely to be victims of crime, can not itself establish an asylum claim".

Sessions' ruling on Monday was seen by immigration experts as a way to narrow how immigration judges interpret the law, and particularly discourage Central American women who have come to the U.S. by the tens of thousands in recent years seeking asylum.

That disqualifies most victims of "personal crimes", the Justice Department said in an accompanying statement that specifically mentions domestic violence. She anticipates other cases in the pipeline may reach the appeals court first. Some said the decision could have wide-ranging impacts on immigrants fleeing gang violence and gender-based violence, including female genital cutting or honor killings.

"I understand that many victims of domestic violence may seek to flee from their home countries to extricate themselves from a dire situation or to give themselves the opportunity for a better life", he continued.

Sessions took aim at one of five categories to qualify for asylum - persecution for membership in a social group - calling it "inherently ambiguous".

Unlike the federal judiciary system, USA immigration courts fall under the Justice Department's jurisdiction, and the attorney general can intervene.

"Today's decision by the Attorney General is yet another attempt to close our doors, " Beth Werlin, executive director of the American Immigration Council.

Immigrant rights advocates say Sessions' decision runs counter to decades of established precedent.

Sessions has been unusually active in this practice compared to his predecessors by exercising his intervention authority to make it tougher for some people to legally remain in the United States. Cracking down on illegal immigration and tightening legal immigration were major themes of President Donald Trump's 2016 campaign.

He remanded the case of A-B- back to Judge Stuart Couch in Charlotte, North Carolina, for further proceedings.

In a speech earlier that day, the Times reported that Sessions bolstered this ruling by saying "asylum was never meant to alleviate all problems-even all serious problems-that people face every day all over the world".
