- A man who can be seen on a video chastising a woman at a Chicago forest preserve for wearing a shirt with the Puerto Rican flag on it has been charged with committing a hate crime, the Cook County State's Attorney's Office announced Thursday.

He has been charged with disorderly conduct and assault.

The woman complained that a man at Caldwell Woods in the Cook County Forest Preserves was questioning her citizenship and telling her she shouldn't be wearing the shirt.

"You're not an American", Trybus screamed at Irizarry.

Puerto Rico is a US territory and its residents are USA citizens, yet Trybus, who is white, told Irizarry that "if you're an American citizen, you should not be wearing that".

Irizarry had posted a Facebook Live video of the June 14 incident, showing Timothy Trybus, who was apparently drunk, repeatedly came up to her and yelled 'Why is she wearing that s**t?'

Irizarry said she received an apology from the forest preserve shortly after she posted the video.

Later, she says: "Officer, I feel entirely uncomfortable, can you remove... please, officer" as the officer is seen walking away from her. "He basically got in my face, damn near nearly touched me", Irizarry is heard saying to the camera during the incident.

"I felt so drawn out", she said in the interview.

"Officer, I'm renting this area and he's harassing me about the shirt I'm wearing, ' Irizzary then tells the cop, who had already been called to the scene to investigate Trybus" intoxicated behavior. They also said that more officers responded and arrested Trybus when the first officer asked for assistance on the radio. The man resumes his abuse, saying: "You're not American".

Almost half of Americans are unaware that Puerto Ricans are United States citizens, according to polling taken after the island was rocked by a hurricane last September.

On Twitter, he said: "We can not allow those who do not understand America's greatness to terrorize people due to their background. You know that, right?"

Cook County President Toni Preckwinkle released a statement Thursday saying, "Under the leadership of General Superintendent Arnold Randall and his team, the Forest Preserves of Cook County have become a safe, welcoming place of exploration, recreation and leisure for everyone".

"You are not going to change us, you know that, right?" "We might start with the fine example presented by Mia Irizarry and her family, who handled this ugly incident with great composure, never stooping to the level of the man who attacked her".

Puerto Rico has been a U.S. territory since 1899. President Woodrow Wilson in 1917 signed into law the Jones-Shafroth Act, granting US citizenship to residents of Puerto Rico.
