Supreme Court Chief Justice John Roberts has referred all judicial misconduct complaints against new Justice Brett Kavanaugh to the Tenth Circuit Court of Appeals in Colorado to investigate, he said in a letter Wednesday.

Fresh off the confirmation of Brett Kavanaugh to the Supreme Court, questions arose about what Republicans might do if another vacancy opens on the court in 2020 - and Republican leadership doesn't agree on what they'd do in that situation.

Although the complaints were originally lodged with the US Court of Appeals for the District of Columbia Circuit, Kavanaugh's former court, the circuit executive of that court asked Roberts to transfer the matters to another circuit out of a "concern that local disposition may weaken public confidence in the process".

"This was just basically sending as strong a signal as we could as candidates to the members who are now in to say that we need to take on these issues upon the new Congress coming in", Ms. Slotkin said.

Kavanaugh was confirmed by a razor-thin 50-48 majority in the U.S. Senate following accusations of sexual misconduct, including one of sexual assault as a high-schooler, that he emphatically denied.

In a statement issued Saturday, D.C. Circuit Judge Karen Henderson said the complaints only 'seek investigations. of the public statements he has made as a nominee to the Supreme Court'.

And he said that "under historic scrutiny", Kavanaugh was "proven innocent".

Another ethicist, Stephen Gillers of New York University, disagreed that the complaints are moot.

The public nature of a case a year ago involving former 9th Circuit judge Alex Kozinski, who was accused of sexual misconduct, was unusual. "Any violation of the Code does not disappear because he is now on another federal court", Gillers said in an email. They typically are dealt with by experienced judges in the courthouse or region where a judge serves.

The ethics complaints were filed against Kavanaugh when he was still a sitting federal judge which made him subject to conduct rules which are ultimately overseen by Roberts himself.
