Rod Rosenstein expected to depart Justice Department in coming weeks following Barr confirmation

Deputy Attorney General Rod Rosenstein - who is overseeing the investigation by special counsel Robert Mueller - is reportedly planning to leave the Justice Department once a new attorney general is confirmed, which could come within a matter of weeks.

While a timetable for his departure is not set in stone, Barr could be confirmed as soon as the beginning of February.

Deputy Attorney General Rod Rosenstein plans to leave the Trump administration in the coming weeks, according to multiple reports Wednesday.

Deputy Attorney General Rosenstein has no concrete plans to depart and will stay on to help with the transition, said the person who asked not to be named.

While Rosenstein was never criticized by Trump as heavily as Sessions was, Trump has cited how Rosenstein signed a FISA surveillance warrant for former Trump campaign adviser Carter Page.

Barr's nomination is likely to meet heavy scrutiny regarding the ongoing investigation, particularly from Democrats, following reports he had written a memo in June questioning the probe.

Speculation of Rosenstein's departure mounted after the firing of former Attorney General Jeff Sessions in November. "My guess is that he is making room for the new attorney general to build a team that he wants around him".

The president has repeatedly decried the DOJ and FBI's efforts to obtain that surveillance warrant, while blasting the Mueller probe Rosenstein previously oversaw as a "witch hunt".

When exactly Rosenstein leaves could shift depending on the timing of Barr's confirmation and the naming of a new deputy attorney general.

ABC News also reported that there is no indication that Trump is attempting to force out Rosenstein, despite their rocky past.

It is not clear who Trump will nominate to fill Rosenstein's position. But Trump opted not to replace him.
